General Terms and Conditions

I. Scope of application, conclusion of contract

The Mühlviertel Tourism Association acts as an intermediary in the business relationship with a person making a booking. A contract is therefore concluded between the person making the booking and the accommodation provider (AP). The following General Terms and Conditions, in the version valid at the time of booking, apply to this contract. Any mutual claims arising from this contract shall only be asserted against the direct contractual partner and without any liability or joint liability on the part of the Mühlviertel Tourism Association. The Mühlviertel Tourism Association will agree with the person making the booking that the ‘General Terms and Conditions for the Hotel Industry (ÖHVB)’ adopted by the hotel industry on 15 November 2006 and the supplementary General Terms and Conditions listed here shall be legally effective for the accommodation contract and for the mediation thereof.

 

II. In particular, the section ‘Withdrawal from the accommodation contract - cancellation fee’ (§ 5) is excerpted from the current AGBH 2006:

  • 5.1 If the accommodation contract provides for a deposit and the contracting party has not paid the deposit on time, the accommodation provider may withdraw from the accommodation contract without granting a grace period.
  • 5.4 Unless otherwise agreed, the accommodation contract may be terminated by the accommodation provider by unilateral declaration for objectively justified reasons up to 92 days before the agreed arrival date of the contracting party.
  • 5.5 The accommodation contract may be terminated by unilateral declaration by the contracting party without payment of a cancellation fee up to 92 days before the agreed arrival date of the guest at the latest.
  • 5.6 Outside the period specified in § 5.5, withdrawal by unilateral declaration of the contracting party is only possible upon payment of the following cancellation fees: - up to 30 days before the day of arrival, 40% of the total package price; - up to 7 days before the day of arrival, 70% of the total package price; - 6 days to the day of arrival: 90% of the total package price.

     

III. Supplementary General Terms and Conditions:

  1. The booking only becomes valid once the host has confirmed it. Without confirmation of the booking, no valid contract is concluded and the guest has no guarantee that the booked service will actually be available.
  2. The contracting parties agree that Austrian law shall apply to the accommodation contract and the agency contract.
  3. No subsidiary agreements have been made.
  4. Amendments and additions to this contract must be made in writing to be legally valid.
  5. The district court of Rohrbach-Berg shall have jurisdiction over any disputes arising from this legal transaction, including disputes concerning the validity of the legal transaction.
  6. The place of performance for the services provided by the Mühlviertel Tourism Association is the municipality of Bad Leonfelden.
  7. The accommodation provider expressly confirms that the AGBH 2006 are legally valid for all bookings; furthermore, the accommodation provider declares that it is fully aware of the general terms and conditions, has received a copy of them and accepts them in full for every booking.
  8. The Mühlviertel Tourism Association guarantees that customer data will only be collected, processed, stored and used for its own marketing purposes in connection with the processing of the travel agency services. The Mühlviertel Tourism Association will only pass on customer data to the hosts involved to the extent necessary for order processing. If guests do not wish to receive marketing information, we ask them to notify us accordingly.

  9.  No guarantee is given for the accuracy of the image material provided by the accommodation providers.
